These Terms of Service (the "Terms") are an agreement between Alethi LLC ("Alethi", "we", "us") and you, and govern your use of the GitStack service at gitstack.sh, including its web interface, APIs, and git hosting (the "Service"). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and "you" includes it.
GitStack is a hosted source-control forge for stacked code review. It
stores git repositories you push to it, renders and manages code
reviews, and can mirror repositories and metadata to and from GitHub at
your direction. The gs command-line tool is licensed
separately under the End User License Agreement distributed with it;
these Terms govern the hosted Service.
You must be at least 13 years old (or the minimum age required in your country) to use the Service. You sign in through GitHub; you are responsible for safeguarding access to your GitHub account and any credentials, tokens, or devices authorized against your GitStack account, and for all activity that occurs under your account. Organization accounts are administered by their owners, who control member access and the data in organization repositories.

Mirroring and issue/CI integration run against GitHub using access you grant through your GitHub account or a GitHub App installation. Your use of GitHub remains governed by GitHub's own terms, and we are not responsible for GitHub's availability or actions.
Our Privacy Policy describes what personal data we collect and how we use it. By using the Service you consent to that collection and use.
We respond to notices of alleged copyright infringement under the DMCA. Send notices identifying the material and its location to [email protected] with the subject "DMCA". We may remove material in response to a valid notice and may terminate repeat infringers' accounts.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, create risk or legal exposure for us or other users, or where required by law; where practical we will notify you and give you an opportunity to export your repositories. After account deletion we will delete your Content within a reasonable period, subject to residual copies in backups that expire on their normal schedule.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATA WILL NOT BE LOST. Keep independent copies of anything you cannot afford to lose; git makes this easy.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALETHI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. ALETHI'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AND ONE HUNDRED US DOLLARS (USD $100).
If you use the Service on behalf of a business, that business will defend and indemnify Alethi against third-party claims arising from your Content or your breach of these Terms.
We may update these Terms. For material changes we will give notice on the Service or by email before the changes take effect. Continuing to use the Service after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-law rules, and disputes are subject to the exclusive jurisdiction of the state and federal courts located in Delaware. These Terms, together with the Privacy Policy and any plan terms presented at purchase, are the entire agreement between you and Alethi about the Service. If a provision is unenforceable, the rest remain in effect; our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
