DMCA Policy

Alethi LLC ("Alethi", "we", "us") operates GitStack, a hosted service at gitstack.sh (the "Service") where users push source code and related material. This policy explains how we handle copyright complaints under the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. Section 512, and how to send us a takedown notice or a counter-notice.

1. Designated Copyright Agent

We have designated an agent to receive notifications of claimed copyright infringement. You can reach the agent at:

2. Filing a notice of infringement

If you believe material hosted on the Service infringes a copyright you own or are authorized to act on behalf of, send a written notice to the Designated Agent above that includes all of the following, as required by 17 U.S.C. Section 512(c)(3):

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work you claim has been infringed, or a representative list if multiple works are covered by one notice.
3. Identification of the material you claim is infringing, with enough detail for us to locate it. A direct URL to the file, repository, or review on gitstack.sh is the most helpful.
4. Your contact information, including your name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

3. What happens after a valid notice

When we receive a notice that satisfies the requirements above, we will remove or disable access to the identified material within a reasonable time and make a good-faith effort to notify the user who posted it and send them a copy of the notice. Removal affects only the material named in the notice.

4. Counter-notification

If you believe material of yours was removed or disabled as a result of mistake or misidentification, you may send a written counter-notice to the Designated Agent. Under 17 U.S.C. Section 512(g)(3), it must include:

1. Your physical or electronic signature.
2. Identification of the material that was removed or disabled and the location at which it appeared before it was removed.
3. A statement, made under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
4. Your name, mailing address, and telephone number, together with a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which the Service may be found), and that you will accept service of process from the person who filed the original notice or their agent.

If we receive a valid counter-notice, we may restore the removed material in not less than 10 and not more than 14 business days after we forward the counter-notice to the party who filed the original notice, unless that party first notifies us that they have filed an action seeking a court order to keep the material offline.

5. Repeat infringers

In appropriate circumstances, and in our discretion, we will limit, suspend, or terminate the accounts of users who are repeat infringers. We may also remove material and terminate access for any user who infringes the intellectual property rights of others, whether or not there is a repeat offense.

6. Misrepresentations

Under 17 U.S.C. Section 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. Please be sure of your rights before you file a notice or a counter-notice, and consider seeking legal advice if you are unsure.
